Ok let me explain it as easy as i can, when the supreme court handles these types of issues weather they are rights or policies they use strict scrutiny In order to determine weather something is constitutional and uses the equal protection clause of the fourteen amendment to do so. Now, marriage isn't a right but it doesnt have to be in order to use strict scrutiny or the 14 amendment to change it. Get iiiiit? (:
