Restrictions of dA when it comes to depicting nudity in Children: http://help.deviantart.com/248/ "Are there restrictions on art using children or teenagers (fictional or otherwise)? Works depicting the likeness of real children or fan art which concerns characters presented as being under the age of eighteen (18) in their original context are subject to several restrictions which are intended to disallow the sexual portrayal of children in the work. Art works depicting the likenesses of real children, whether painting, sketch, or otherwise, may not depict any child over the age of two who is explicitly nude, nor can they be depicted in any sexually provocative theme or manner of dress. Fan art of fictional characters that are considered underage or children in their original context may not be depicted with exaggerated breasts, buttocks, or genital areas nor may they be depicted in any erotic manner or in any sexually provocative scene or manner of dress. Characters which have been portrayed as a range of ages in their original media will be classified as underage or not based upon their average age over the series. Attempts to "age" the characters in order to depict them in a manner which would otherwise be prohibited will not be granted any exception. Artworks using completely original fictional characters which appear to be minors or children shown nude or placed into sexual situations will be judged by the deviantART staff based on the appearance, style and anatomy of the character and all other available information in order to determine whether or not the work will be acceptable. Additionally works which depict any romantic or sexual relationship between a minor and an adult can be subject to removal without notice." So not law but how dA treats those who post nudity in children.

Well it's rare to be indicted for possession of it but it has happened to a few in the states. Mostly it's someone else (like an angry significant other) or a hacker, (who claims they are doing it for the better of mankind) who reports someone to local authorities. I've read a news story about about a wife reporting to authorities that their husband had pornographic Simpsons comics that depicted minors in it engaging in sexual intercourse. He got a prison sentence if I remember correctly. I see what you are saying, that there's no way they can police it 100% but can any agency can? Maybe a real test to the legality of fictional characters, who are miniors, in sexual activities state-side would be if a company had the cajones to license the Kiss X Sis OVAs or even Po-ju's recent work about a trap and see what happens? I've noticed in hentai that's licensed in the states, that in the beginning of the video, they have a warning stating that basically no identifiable minor is in the production of the video. Then in the Japanese language track a character states an age under 18 but subtitled 18 or older. I love it when it's obviously a high school setting, the sailor uniforms are a dead give-a-way, and it's subtitled and ENG dubbed as a "college" setting. LFMAO~!

I actually find it very queer how violence isn't a big deal in the states but sex is. I rather let my kids watch anything else but violence; what the hell is wrong with people? Just my opinion. Nonetheless violence in fiction is still fake so it's not a big deal. I have a healthy mind and know the difference between what's real and what's not and what's "appropriate" or "acceptable" in society.

Yeah Rina, I think dA does that to just completely avoid potential lawsuits (legal or not) so that they don't have headaches about it. Their rule of thumb is basically the same with it comes to realism of fictional minors in sexual situations in the states. It boils down to that's "obscene" to a community; which I find a bit arbitrary but that's the law of the land.
